The following terms and conditions are a legal agreement between you and Teracom Training Institute Ltd., its related and affiliated companies and assignees ("Teracom", "we"), for use of Teracom products, which include the teracomtraining.com website, videos, course books, textbooks, eBooks, online courses and certifications, billing and payment systems, electronic files, courses and documentation, trademarks and service marks registered or not, computer software, and any updates or supplements thereto ("TERACOM PRODUCT").
If you do not agree to these terms and conditions, do not purchase, install or use the TERACOM PRODUCT.
INTELLECTUAL PROPERTY RIGHTS
I agree that Teracom retains all rights to the TERACOM PRODUCT, including ownership of the content, copyright, intellectual property rights and reproduction rights. I agree that no part of the TERACOM PRODUCT which I receive will be reproduced or transmitted in any form or by any means, electronic or mechanical, including photocopying, duplication, recording, or by any information storage and retrieval system. I also agree that the TERACOM PRODUCT will not be re-sold, hired out, loaned out, distributed, be part of a public or educational institution library, loaned to third parties, nor presented publicly in any way. I agree to not use the TERACOM PRODUCT as the basis for teaching anyone without the express written consent of Teracom.
By evaluating or purchasing a TERACOM PRODUCT or otherwise creating an account on the myTeracom customer care system, I agree that Teracom Training Institute may communicate with me by email, and send me the Teracom newsletter, published approximately 10 times per year. I can unsubscribe from the newsletter anytime.

PHYSICAL PRODUCT WARRANTY
Defective products will be exchanged for the same item within one year. Processing fee of 10% for customer-requested credits. Please see www.teracomtraining.com/faqs.htm for full details. Replacement of defective products may be effected by contacting Teracom for a Return Material Authorization (RMA) number and return address, and shipping the product prepaid to Teracom with proof of delivery. No shipments will be accepted without an RMA number.
INTERNATIONAL TAXES, DUTIES AND BROKERAGE CHARGES
I agree that if I am requesting Teracom to ship TERACOM PRODUCT to a country other than the USA or Canada, that I am responsible for paying any taxes or duties imposed by the destination country and any brokerage charges imposed at the destination, and that these charges if any are not included in the amount paid to Teracom.
The TERACOM PRODUCT is protected by United States copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. All title and copyrights in and to the TERACOM PRODUCT (including but not limited to any images, photographs, animations, video, audio, music, text, and "applets" incorporated into the TERACOM PRODUCT) and any copies of the TERACOM PRODUCT are owned by Teracom or its suppliers. You must treat the TERACOM PRODUCT like any other copyrighted material. You may not print the TERACOM PRODUCT.
Teracom may provide you with support services related to the TERACOM PRODUCT ("Support Services"). Use of Support Services is governed by Teracom polices and is limited to on-line documentation in the form of a Frequently-Asked Questions (FAQ) and Answers list only. Support for any other software or hardware is provided by the manufacturer or seller of that hardware or software. With respect to technical information you provide to Teracom as part of the Support Services, Teracom may use such information for its business purposes, including for product support and development. Teracom will not utilize such technical information in a form that personally identifies you.
Without prejudice to any other rights, Teracom may terminate this agreement if you fail to comply with the terms and conditions of this agreement, including non-payment. In such event, you must destroy all copies of the TERACOM PRODUCT and all of its component parts.
U.S. GOVERNMENT RESTRICTED RIGHTS
The TERACOM PRODUCT and documentation are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial Computer Software-Restricted Rights at 48 CFR 52.227-19, as applicable. You agree that you will not export or re-export the TERACOM PRODUCT, any part thereof, or any process or service that is the direct product of the TERACOM PRODUCT (the foregoing collectively referred to as the "Restricted Components"), to any country, person, entity or end user subject to U.S. export restrictions. You specifically agree not to export or re-export any of the Restricted Components (i) to any country to which the U.S. has embargoed or restricted the export of these goods or services, which may currently include, but not necessarily limited to Cuba, Iran, Iraq, Libya, North Korea, Sudan and Syria, or to any national of any such country, wherever located, who intends to transmit or transport the products back to such country; (ii) to any end-user who you know or have reason to know will utilize the Restricted Components in the design, development or production of nuclear, chemical or biological weapons; or (iii) to any end-user who has been prohibited from participating in U.S. export transactions by any federal agency of the U.S. government. You warrant and represent that neither the BXA nor any other U.S. federal agency has suspended, revoked or denied your export privileges.
If you acquired the product in the United States, this agreement is governed by the laws of the State of Nevada. If you acquired the product anywhere else, this agreement is governed by the laws of the Province of Quebec, Canada.

THE TERACOM PRODUCT AND ANY RELATED DOCUMENTATION IS PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OR NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF THE TERACOM PRODUCT REMAINS WITH YOU.
DISCLAIMER AND WAIVER OF LIABILITY

In any case, Teracom's entire liability under any provision of this agreement shall be limited to the greater of the amount actually paid by you for the Software Product or U.S. $5.00. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
Client may not assign or transfer its rights or obligations under this contract in any way to any third party.
In the unlikely event any term, condition or clause of this agreement be determined to be invalid by a court of law, that term shall be struck from the agreement and the agreement shall continue with all other terms unchanged.
